Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Mastii, a video Over-The-Top (OTT) platform ("Platform"), owned and operated by ARJ Solutions LLP ("ARJ Solutions," "we," "us," or "our"). By accessing or using Mastii, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from accessing or using the Platform.

1. Acceptance of Terms:

By accessing or using Mastii, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional terms and conditions, policies, guidelines, or rules applicable to specific features or services offered on the Platform.

2. Eligibility:

You must be at least 18 years old or have reached the legal age of majority in your jurisdiction to access or use Mastii. By accessing or using the Platform, you represent and warrant that you meet these eligibility requirements.

3. User Accounts:

To access certain features of Mastii, you may need to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Content:

a. Mastii may allow you to access, view, and stream a variety of audiovisual content, including but not limited to movies, television shows, documentaries, and original productions ("Content").

b. You acknowledge that all Content made available on Mastii is protected by copyright, trademark, and other intellectual property rights owned by ARJ Solutions or its licensors. You agree not to modify, reproduce, distribute, transmit, display, perform, or create derivative works of any Content without prior written authorization from the respective rights holders.

c. ARJ Solutions reserves the right to remove or restrict access to any Content on Mastii at any time without prior notice and for any reason.

5. Subscription Plans:

a. Mastii offers subscription plans ("Subscription Plans") that provide access to premium Content and features on the Platform.

b. Subscription Plans may vary in duration, pricing, and available features. Details of available Subscription Plans, including pricing and billing terms, will be provided on the Mastii website or mobile application.

6. Subscription Activation and Billing:

a. To subscribe to a Subscription Plan, you must create a user account on Mastii and provide valid payment information.

b. By subscribing to a Subscription Plan, you authorize ARJ Solutions to automatically charge the applicable subscription fees to your chosen payment method at the beginning of each billing cycle.

c. Subscription fees are non-refundable, except as otherwise provided in these Terms or required by applicable law.

7. Free Trials:

a. Mastii may offer free trial periods for certain Subscription Plans. The duration and terms of any free trial period will be specified at the time of sign-up.

b. At the end of the free trial period, your subscription will automatically renew, and you will be charged the applicable subscription fee unless you cancel your subscription before the end of the trial period.

8. Subscription Renewal and Cancellation:

a. Subscription Plans automatically renew at the end of each billing cycle unless you cancel your subscription before the renewal date.

b. You may cancel your subscription at any time by accessing your account settings on Mastii or by contacting customer support. Upon cancellation, your access to premium Content and features will terminate at the end of the current billing cycle, and you will not be charged for any subsequent billing periods.

c. ARJ Solutions reserves the right to suspend or terminate your subscription or access to Mastii at any time for any reason, including but not limited to violation of these Terms or non-payment of subscription fees.

9. Subscription Price Changes:

a. ARJ Solutions reserves the right to change the pricing of Subscription Plans at any time. Changes to pricing will apply to new subscriptions or renewals initiated after the price change becomes effective.

b. ARJ Solutions will provide notice of any changes to subscription pricing through the Mastii website or mobile application or by email.

10. Refunds:

a. Except as otherwise required by applicable law, subscription fees are non-refundable. No refunds or credits will be provided for partial subscription periods or unused portions of Subscription Plans.

b. In the event of a material change to a Subscription Plan or a significant interruption in service, ARJ Solutions may, in its sole discretion, provide refunds or credits to affected subscribers.

11. Third-Party Payment Processors:

a. Payment processing services for Mastii are provided by third-party payment processors. By subscribing to a Subscription Plan, you agree to abide by the terms and conditions of the applicable payment processor in addition to these Terms.

b. ARJ Solutions is not responsible for any errors, delays, or other issues arising from the use of third-party payment processors.

12. User Conduct:

a. You agree to use Mastii only for lawful purposes and in accordance with these Terms and any applicable laws and regulations.

b. You agree not to engage in any of the following prohibited activities:

   i. Violating any applicable laws or regulations;

   ii. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;

   iii. Interfering with or disrupting the operation of Mastii or servers or networks connected to Mastii;

   iv. Using automated means, including spiders, robots, crawlers, data mining tools, or the like, to access or use Mastii;

   v. Uploading, posting, or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;

   vi. Collecting or storing personal data about other users without their express consent.

13. Privacy Policy:

Our Privacy Policy governs the collection, use, and disclosure of your personal information when you access or use Mastii. By accessing or using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

14. Disclaimers:

a. Mastii is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied.

b. ARJ Solutions does not warrant that Mastii will be error-free or uninterrupted, or that defects will be corrected.

c. ARJ Solutions disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability:

To the fullest extent permitted by applicable law, ARJ Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use Mastii; (ii) any conduct or content of any third party on Mastii; or (iii) unauthorized access, use, or alteration of your transmissions or content.

16. Indemnification:

You agree to indemnify, defend, and hold harmless ARJ Solutions and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of Mastii.

17. Modifications:

ARJ Solutions reserves the right to modify or update these Terms at any time without prior notice. Your continued access to or use of Mastii after any such modifications constitute your acceptance of the revised Terms.

18. Governing Law and Jurisdiction:

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your access to or use of Mastii shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India.

19. Entire Agreement:

These Terms constitute the entire agreement between you and ARJ Solutions regarding your access to and use of Mastii and supersede all prior and contemporaneous agreements and understandings, whether oral or written.
